The deal between you and Birddog.

Plain-English summary first: you can use Birddog to run your shop. Pay your bill on time. Don't use it to break the law. We'll keep the service running, but software is not a guarantee -- the legal limits are below. The detail follows.

Who you're agreeing with

These Terms are between you (the “Shop” or “you”) and Alamobrass Technologies LLC, a Texas limited liability company doing business as Birddog CRM (“Birddog,” “we,” “us”). By creating an account or using Birddog, you accept these Terms. If you're agreeing on behalf of a business, you confirm you're authorized to bind that business.

What the service is

Birddog is software for independent firearms retailers -- customer profiles, wishlists, receiving and auto-matching, special orders, layaways, builds, the customer portal, optional email and SMS, distributor lookups, and accounting integration. Features available to you depend on your plan tier (Pup, Counter, Shop, Kennel).

Acceptable use

You agree to use Birddog only for lawful business purposes. Specifically, you will not use Birddog to facilitate, record, or otherwise support any firearms transaction that violates federal, state, or local law -- including straw purchases, sales to prohibited persons, transactions across state lines that bypass an FFL transfer, or any other transaction not permitted under your FFL or applicable statutes. Your ATF bound book and other compliance obligations remain entirely yours; Birddog is a CRM and is not a bound-book replacement.

You will not attempt to reverse-engineer, copy, scrape, or resell Birddog; circumvent rate limits or tier gates; or use the service to send unsolicited bulk messages outside of properly opted-in customer relationships.

Your account

You're responsible for keeping your sign-in credentials safe and for everything done through your account. If you discover unauthorized use, tell us at support@getbirddogcrm.com as soon as you can. Adding teammates with their own logins is encouraged -- sharing one login between people is not.

Your customers' data

When you put customer records into Birddog, you remain the data controller of those records; Birddog is the processor acting on your instructions. You confirm that you have the right to enter that data -- including any consent needed under state law -- and that you'll honor your customers' opt-out requests for emails, SMS, and voicemail. Our Privacy Policy has the specifics on how we handle data on your behalf.

Free trial

New shops get a 14-day Shop-tier trial without entering a payment method. At the end of the trial you pick a paid plan or your account is locked behind an upgrade prompt -- your data stays put indefinitely while you decide. We'll send a reminder before the trial ends.

Plans and billing

Paid plans bill monthly or annually in advance through our payment processor. Prices are listed on the pricing page and may change with at least 30 days' notice before renewal. SMS and voicemail packs are billed separately as add-ons. Taxes are added where applicable.

You can cancel any time from your billing settings. Cancellation stops the next renewal; you keep access until the current term ends.

Text messaging

When you enable SMS features in Birddog, your customers receive transactional text messages from the shop's toll-free number -- order-ready alerts, wishlist-match notifications, and layaway reminders. You are responsible for obtaining valid opt-in consent from your customers before enabling SMS for their profiles.

Required opt-in language. When collecting a customer's phone number, you must inform them that they may receive text messages from your shop via Birddog and that standard message and data rates may apply.

Opt-out. Customers can reply STOP at any time to opt out. Birddog honors all opt-outs automatically and will not send further messages to opted-out numbers. You must not attempt to re-enroll an opted-out customer without their explicit renewed consent.

Prohibited content. You may not use Birddog's SMS features to send marketing blasts, political messages, SHAFT content (sex, hate, alcohol, firearms marketing, tobacco), or any content prohibited by CTIA guidelines or carrier policies. SMS is for transactional notifications only.

Carrier. SMS is delivered via SignalWire using toll-free number +1 (888) 435-9298. Message and data rates may apply to your customers. Delivery is not guaranteed across all carriers.

Refunds

Monthly plans. Monthly subscription fees are non-refundable for the current billing period. You can cancel before the next renewal date to stop future charges.

Annual plans. Annual plans cancelled within 30 days of the initial purchase date are eligible for a prorated refund of unused months. After 30 days, annual plans are non-refundable but access continues through the end of the paid term.

Trial accounts. The 14-day trial is free -- no payment is collected and no refund applies.

SMS setup fee. The one-time SMS setup fee is non-refundable once your number is provisioned and your toll-free number is verified. Monthly SMS pack fees are non-refundable for the current billing period.

Payment processing fees. Transaction fees charged by our payment processor for shop-customer transactions are non-refundable. Disputes and chargebacks between your shop and your customers are governed by your agreement with the payment processor.

To request a refund, email support@getbirddogcrm.com with your account name and the details. Eligible refunds are processed within 10 business days to the original payment method.

Payments to your shop, by your customers

Some features let your customers pay you through the service (layaway deposits, build payments, balances). Those payments are processed by our payment partner Payroc, under their merchant terms with you. Birddog never holds your funds and never touches card data -- card entry goes straight to the processor's hosted fields. Disputes, chargebacks, and reconciliation between you, your customer, and Payroc are governed by Payroc's agreement with you; Birddog assists where it can but is not a party to those payment transactions.

Third-party services

Distributor lookups, email delivery, SMS and voicemail, payment processing, and accounting integrations rely on third-party providers. We pass requests to those providers on your behalf and don't guarantee their availability, accuracy, or pricing. If a vendor changes terms or pricing, we'll pass on what we know but the underlying relationship is between you and that vendor (or, in some cases, between us and the vendor with you as the end user).

Service availability

We aim for high availability but don't guarantee uninterrupted service. Maintenance windows, vendor outages, and unforeseen problems happen; we'll communicate material issues on the status page. We may also evolve features, deprecate older ones with reasonable notice, and adjust limits to keep the service stable for everyone.

Your content, your ownership

You own the data you put into Birddog. You grant us a limited license to host, process, and display it strictly to operate the service for you. We don't sell your data and don't use it to train AI models for other customers.

Our IP

The Birddog software, brand, and content are ours (or our licensors'). Using the service doesn't transfer any of those rights to you beyond the right to use Birddog for your shop under these Terms.

Feedback

If you send us suggestions, bug reports, or feature ideas, you grant us a non-exclusive, royalty-free license to use them to improve Birddog -- without obligation to compensate you. We love hearing this stuff; please send it.

Termination

You can close your account any time. We can suspend or terminate access if you materially breach these Terms -- especially the Acceptable use section -- or if continuing the service would expose Birddog to legal or regulatory risk. On termination, you can export your data for a reasonable wind-down period.

Warranty disclaimer

Birddog is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties -- express or implied -- including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted, error-free, or that defects will be corrected, and we don't warrant the accuracy or completeness of data returned by third-party services (distributor catalogs, accounting systems, etc.).

Limitation of liability

To the maximum extent permitted by law, Birddog and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages -- including lost profits, lost data, or business interruption -- arising out of or related to the service. Our total cumulative liability for any claim is capped at the greater of (a) the fees you paid Birddog in the twelve months before the claim arose or (b) one hundred US dollars.

Indemnification

You agree to defend and indemnify Birddog against claims arising from (i) your use of the service in violation of these Terms or law, (ii) the firearms transactions and compliance obligations that are yours to manage as the FFL, and (iii) content you put into the service that infringes someone else's rights.

Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Comal County, Texas, and both sides consent to that jurisdiction. Either side may seek injunctive relief in any court of competent jurisdiction to protect its IP.

Changes to these Terms

We may update these Terms from time to time. If we make material changes we'll update the date above and, where appropriate, notify you in-app or by email. Continued use after a change means you accept the updated Terms.
